Chief Labour Commissioner Calls Infosys In New Delhi For Discussion Regarding Non-Compete Clause For IT Employees – Punekar News

Pune, 14th May 2022: Based on the complaint from the Pune-based Nascent Information Technology Employees Senate (NITES), an organisation of IT employees, the Chief Labour Commissioner has called Infosys for a joint discussion in New Delhi regarding their non-compete clause for the employees.
Earlier, the IT giant had skipped a meeting in Bengaluru on the ground that it has not received a copy of the grievance submitted by NITES.
The clauses of the Infosys are as follows:
“I agree that for a period of six (6) months following the termination of my employment with Infosys for any reason, I will not:
a. accept any offer of employment from any Customer, where I had worked in a professional capacity with that Customer in the twelve (12) months immediately preceding the termination of my employment with Infosys;
b. accept any offer of employment from a Named Competitor of Infosys, if my employment with such Named Competitor would involve me having to work with a Customer with whom I had worked in the twelve (12) months immediately preceding the termination of my employment with Infosys.”
The Union Labour Ministry has issued a notice to Krish Shankar, Group Head – Human Resources, Infosys, to appear before the Chief Labour Commissioner or send his representative for a joint discussion on the issue.
The notice states, “This is in reference to the public grievance made by Sh. H.S. Saluja (President from NITES) regarding
arbitrary, unethical and illegal clause incorporated in the employment contract of the employees working for
Infosys Ltd. A copy of the public grievance was forwarded to your office earlier through speed post so as to enable
your office to submit comments on the above referred public grievance by NITES for the meeting scheduled on
28.4.2022 at 3.00 PM before the CLC(C) at Shram Shakti Bhawan, New Delhi.
However. vide your office email it was informed to the O/O CLC(C) New Delhi that your office has not received the copy of the public grievance and the same be made available and also sought a fresh date to attend the meeting. As requested a copy of the public grievance is being made available vide this email as attachment. The O/O CLC(C) New Delhi has decided to give your office another opportunity to attend the meeting before Chief Labour Commissioner (C) at Room No. 505, 5″ Floor, Shram Shakti Bhawan, and New Delhi on 17.05.2022 at 3.00 PM positively.
The reply/written statement with respect to the public grievance of NITES can be submitted on or before 16.5.2022.
In view of above, you are requested to make it convenient to attend the above mentioned joint discussion either personally or through an authorized representative well conversant with the issue on the above scheduled
date, time and venue.
This is being issued with the approval of Competent Authority.”
